Please read these Terms of Service carefully before using Export Reader. ExportReader is operated by Lee Nolan, who is the contractual provider of the Service. By accessing or using our service, you agree to be bound by these terms.
1. Acceptance of Terms
By creating an account, uploading files, or using any part of Export Reader ("the Service"), you agree to these Terms of Service and our Privacy Policy. If you do not agree, you must not use the Service.
These terms constitute a legally binding agreement between you and Export Reader.
2. Service Description
Export Reader provides a platform for:
- Uploading and storing chat conversation archives (ZIP format)
- Indexing and searching your personal chat history
- Creating and managing conversation snippets
- Organizing conversations with tags and metadata
The Service is provided "as is" and we reserve the right to modify, suspend, or discontinue any feature at any time.
3. User Accounts & Eligibility
Account Requirements:
- You must be at least 16 years old to use this Service
- You must provide accurate and complete registration information
- You are responsible for maintaining the security of your account credentials
- You must not share your account with others
- One account per person (no multiple accounts without permission)
Account Security:
- You are solely responsible for all activity under your account
- Notify us immediately of any unauthorized access
- We are not liable for losses due to stolen or compromised credentials
4. Acceptable Use Policy
You agree NOT to:
- Upload malicious content: viruses, malware, executable code, shell scripts, or any harmful files
- Violate laws: use the Service for any illegal purpose or in violation of any regulations
- Infringe rights: upload content you don't have rights to, including copyrighted material
- Abuse the system: attempt to bypass security measures, rate limits, or access restrictions
- Attack infrastructure: conduct DDoS attacks, port scanning, or penetration testing
- Scrape or harvest: use automated tools to extract data without permission
- Impersonate others: misrepresent your identity or affiliation
- Spam or phish: send unsolicited communications or deceptive content
- Resell access: redistribute, sublicense, or commercialize the Service
- Reverse engineer: decompile, disassemble, or attempt to derive source code
⚠️ Violation Consequences: Accounts found violating these terms will be immediately suspended or terminated. Malicious uploads trigger automatic bans. We reserve the right to report illegal activity to authorities.
5. Content & Intellectual Property
Your Content:
- You retain all ownership rights to content you upload
- You grant us a limited license to store, process, and display your content solely to provide the Service
- You represent that you have all necessary rights to upload your content
- You are solely responsible for the content you upload
Our Content:
- The Service, including all software, design, and branding, is owned by Export Reader
- You may not copy, modify, or distribute any part of the Service
- All trademarks and logos are property of their respective owners
6. Service Availability & Limitations
No Guarantees:
- We do not guarantee 100% uptime or availability
- The Service may be interrupted for maintenance, updates, or emergencies
- While we take reasonable measures to protect your data, you should maintain your own backups
- Storage limits apply based on your plan tier
Plan Limits:
- Free tier: 100 MB uploads
- Active tier: 1 GB uploads
- Power tier: 5 GB uploads
- We may change limits with notice
7. Payment & Billing (When Applicable)
Currently in Beta: All plans are currently free during our beta period. When billing begins:
- Prices will be clearly displayed on the Pricing page
- You will be notified before any charges occur
- Subscriptions renew automatically unless cancelled
- Failure to pay may result in service suspension
Refund Policy:
- All sales are final unless required by applicable law
- Refunds may be granted at our discretion in cases such as accidental purchase or service malfunction
8. Termination
By You:
- You may delete your account at any time from Settings
- Deletion is permanent and cannot be undone
- All your data will be permanently removed from our servers
By Us:
- We may suspend or terminate accounts that violate these Terms
- We may suspend or terminate accounts for any reason with or without notice, subject to applicable consumer and data-protection laws
- Malicious activity results in immediate termination and IP ban
- We may suspend accounts for attempts to compromise the security or stability of the Service
- Upon termination, your access ends immediately
- We may delete your data after termination, in accordance with our Privacy Policy
Post-Termination Data Handling:
- Stored chat files and metadata are permanently removed from active storage
- Automated backups containing deleted data are overwritten on normal rotation
- You may request a final export of your account data before deletion
- If your account becomes inactive for an extended period, we may remove stored files after providing reasonable notice
9. Disclaimers & Limitation of Liability
SERVICE PROVIDED "AS IS":
- We make no warranties about the Service's reliability, accuracy, or fitness for purpose
- We do not guarantee error-free or uninterrupted service
- We are not responsible for content uploaded by users
- Use the Service at your own risk
LIMITATION OF LIABILITY:
- To the maximum extent permitted by law, Export Reader is not liable for any indirect, incidental, special, or consequential damages
- This includes loss of data, profits, or business opportunities
- Our total liability shall not exceed the amount you paid us in the past 12 months (or $100 if no payment)
- Some jurisdictions do not allow liability limitations, so these may not apply to you
10. Indemnification
You agree to indemnify, defend, and hold harmless Export Reader and its operators from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Content you upload to the Service
11. Data Protection & Privacy
Your use of the Service is also governed by our Privacy Policy, which explains:
- What data we collect and why
- How we protect your data
- Your rights regarding your data
- How to delete your data
Your use of the Service is subject to our Privacy Policy, which forms part of this agreement.
Third-Party Infrastructure:
ExportReader may use third-party infrastructure providers (e.g., hosting, email, backups). These providers are contractually obligated to protect your data and may only access it when required to operate the service.
12. Security & Enforcement
Automated Security:
- All uploads are automatically scanned for malicious content
- Malicious files trigger immediate account locks and IP bans
- Security incidents are logged and may be reported to authorities
- We employ rate limiting and abuse detection systems
Enforcement:
- We reserve the right to investigate violations
- We may access your content if required by law or to enforce these terms
- We cooperate with law enforcement when legally required
13. Changes to Terms
We may update these Terms at any time. When we do:
- We will update the "Last updated" date at the top
- Material changes will be communicated via email or in-app notice
- Continued use after changes constitutes acceptance
- If you don't agree to new terms, you must stop using the Service
14. Miscellaneous
Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement between you and Export Reader.
Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
No Waiver: Our failure to enforce any right does not waive that right.
Assignment: You may not transfer your rights under these Terms. We may assign our rights to any successor.
Force Majeure: We are not liable for delays or failures due to circumstances beyond our control.
15. Governing Law
These Terms are governed by the laws of Spain. Any disputes will be resolved in the courts of Spain, unless mandatory local consumer law gives you different rights.
